Chapter I General Provisions

Relevant departments such as development and reform, natural resources bureau, housing and urban-rural construction, public security, market supervision, civil affairs, education, auditing, taxation, comprehensive administrative law enforcement, etc., should cooperate according to their respective responsibilities and ensure the smooth progress of housing collection and compensation. .

Chapter II Levy Decision
为了保障国家安全、促进国民经济和社会发展等公共利益的需要，有下列情形之一，确需征收房屋的，由县（市、区）人民政府作出房屋征收决定： Article 8 In order to protect national security, promote the national economic and social development and other public interest needs, in one of the following circumstances, where house acquisition is indeed required, the county (city, district) people's government shall make a house acquisition decision:

(3) the needs of public utilities such as science and technology, education, culture, health, sports, environmental and resource protection, disaster prevention and mitigation, cultural relics protection, social welfare, and municipal utilities implemented by the government;
(4) the need for the construction of a guarantee housing project implemented by the government;
(5) The need for the reconstruction of old urban areas in areas such as the concentration of dilapidated houses and poor infrastructure, organized and implemented by the government in accordance with the relevant provisions of the Urban-Rural Planning Law;
(6) The needs of other public interests stipulated by laws and administrative regulations.

(1) Approval documents for construction project approval;
(2) Opinions on site selection for construction projects;
(3) Relevant materials of the construction project that conform to the overall land use plan;
(4) Other relevant materials to be submitted.
县（市、区）人民政府在作出房屋征收决定前，房屋征收部门应当按照有关规定进行社会稳定风险评估，制定并认真落实各项防范、化解、处置措施。 Article 11 Before the people's government of a county (city, district) makes a decision on house expropriation, the house expropriation department shall conduct a social stability risk assessment in accordance with relevant regulations, formulate and seriously implement various preventive, defusing, and disposal measures.

The determination result is used as the basis in house expropriation and compensation. If the parties have objections to the determination result, they may apply to the determination department for review.

(3) Other acts of improper increase of compensation fees.
After the suspension notice is issued, if the requisitioned person renovates the house, re-leases or divides the household, the requisitioned person and other related persons will not be compensated.
The suspension period shall not exceed one year from the date of the announcement.
县（市、区）人民政府应当组织有关部门对所制定的房屋征收补偿方案进行论证，在房屋征收范围内进行公布并征求公众意见，征求意见时间不得少于30日。 Article 15 The people's government of a county (city, district) shall organize relevant departments to demonstrate the compensation plan for house expropriation, and make an announcement within the scope of house expropriation and solicit public opinions. If the house acquisition decision involves more than 200 households, the decision shall be discussed and decided at the executive meeting of the people's government at the corresponding level, and a meeting minutes shall be formed.

(4) Compensation plan for house expropriation, including compensation method for house expropriation, calculation method for the difference between the value of the expropriated house and the value of the property exchange house, the location for the property exchange house, relocation costs, temporary resettlement methods and standards, subsidies, reward standards, etc .;
(5) Failure to reach an agreement or an unclear treatment method of the owner of the expropriated house;
(6) the identification and results of houses without property rights registration;
(7) Contact information of the entrusted implementation unit and relevant persons in charge;
(8) Methods and channels for obtaining relevant materials for house expropriation, consultation place, contact information, and person responsible for the expropriation site;
(9) Right of administrative review and administrative litigation;
(10) Other matters that should be announced.
Chapter III Compensation
作出房屋征收决定的县（市、区）人民政府应当对被征收人给予下列补偿： Article 21 The people's government of a county (city, district) that has made a decision on house expropriation shall give the following compensation to the expropriated:
(1) Compensation for the value of requisitioned houses and auxiliary facilities;
(2) Compensation for relocation and temporary resettlement due to house acquisition;
(3) Compensation for production and business losses due to house acquisition.
被征收房屋的建筑面积和结构原则上以被征收人不动产权证书记载为准；不动产权证书登记事项不明确或与现状不符的，由房屋征收部门提出意见，委托具有专业测绘资质的机构对现状进行实地勘测认定，报县（市、区）人民政府确定并公示。 Article 22 The building area and structure of the requisitioned house shall in principle be recorded in the immovable property certificate of the requisitioned person; if the registration of the immovable property certificate is not clear or does not conform to the status quo, the house expropriation department shall submit an opinion and entrust professional surveying and mapping Qualified institutions shall conduct on-site investigation and identification of the status quo, and report to the county (city, district) people's government for determination and publicity.
摸底调查工作结束后，房屋征收部门组织被征收人选定评估机构及开展评估作业，评估结果应在征收范围内公示。 Article 23 After the investigation work is completed, the house acquisition department organizes the requisitioned person to select an evaluation agency and carry out evaluation operations. The evaluation results shall be publicized within the scope of the acquisition. The selected evaluation agency shall not refuse, transfer, or transfer in disguised form the entrusted house collection and evaluation business.
If the requisitioned person disagrees with the evaluation result, he shall apply to the real estate price evaluation agency for review and evaluation within 10 days from the date of receiving the evaluation report. If the requisitioned person disagrees with the review result of the real estate price assessment agency, it shall apply to the real estate price assessment expert committee for appraisal within 10 days from the date of receiving the review result.
被征收人可以选择货币补偿，也可以选择房屋产权调换。 Article 24 The requisitioned person may choose monetary compensation or exchange property rights. Those who choose to monetize compensation can buy it from the government-supplied house inventory.
If the requisitioned person chooses the property right exchange, the county (city, district) people's government shall provide the house for the property right exchange, and calculate and settle the difference between the value of the requisitioned house and the value exchanged house with the requisitioned person.
In the case of expropriation of dwellings due to reconstruction of old urban areas, new dwellings in the rebuilt area or in the nearest area shall be given priority for resettlement where the requisitioned person chooses to exchange property rights; if there is no new dwelling or insufficient resettlement of new dwelling, it shall be implemented in accordance with the second paragraph of this article.

被征收房屋价值评估不含装饰装修及附属设施，装饰装修及附属设施补偿明细可在房屋征收安置方案制定中对共性部分经评估后列表参照，对特殊装饰装修当事人均可以申请个案评估。 Article 26 The evaluation of the value of the house to be requisitioned does not include the decoration and auxiliary facilities. 房屋征收与补偿应当制定相应奖励制度，对积极配合房屋征收活动的被征收人给予奖励。 Article 27. House acquisition and compensation shall establish a corresponding reward system to reward those who are actively assisting in house acquisition activities. The specific items and standards of awards shall be formulated by the people's government of the county (city, district) in accordance with the situation in the administrative area.
采取房屋产权调换的，县（市、区）人民政府应当合理设置过渡期限。 Article 28 For the exchange of housing property rights, the county (city, district) people's government shall reasonably set the transition period. The turnover period for the construction of high-rise buildings shall not exceed 36 months, and the turnover period for the construction of multi-storey buildings shall not exceed 24 months. The turnover period shall be calculated from the date of signing the agreement and relocating the house. The relocation fees and temporary resettlement fees shall be formulated by the county (city, district) people's government.
As the expropriator's responsibility extends the transition period, the temporary resettlement fee will be increased by 50% from the original standard within 6 months from the overdue month, 100% within 7-12 months, and 150% within 13-18 months. , 200% increase in 19 to 24 months, 300% increase after 24 months, up to 300%.
After choosing to exchange property for resettlement housing overdue for more than 24 months, the requisitioned person can choose monetized resettlement again, and the compensation standard will be re-evaluated for the original area of the original house for monetization resettlement according to the current valuation point. The temporary resettlement fee received will not be refunded. .
被征收房屋涉及生产、养殖、大型机器设备、物资及特种（殊）物品的搬迁费，由双方参照市场行情协商确定，也可以选择评估机构评估确定。 Article 29 The relocation cost of the house to be requisitioned for production, breeding, large machinery and equipment, materials and special (special) items shall be determined through consultation between the two parties with reference to market conditions, or an evaluation agency may be selected for evaluation.
因征收房屋造成停产停业的，应当给予经营性损失补偿和职工失业补助，县（市、区）人民政府可以结合本地实际制定补偿（助）标准。 Article 30 In case of suspension of production or business due to house expropriation, compensation for operating losses and unemployment compensation for employees shall be provided. The county (city, district) people's government may formulate compensation (assistance) standards in accordance with local conditions.
If the requisitioned person chooses monetary compensation, it will be calculated according to the standard for 3-6 months of operating loss compensation and employee unemployment benefits; if the requisitioned person chooses the exchange of housing property rights, the one-time calculation will be made for 3-6 months. Compensation for operating losses and subsidies for unemployment of employees; the requisitioned person does not pay the compensation for the loss of production and business suspension if he chooses a revolving house provided by the house collection department; if the requisitioned person chooses to transition by himself, the operating loss compensation and 6-month employee unemployment benefit.
The nature of house use shall be subject to the real estate registration record. If it is not registered or does not conform to the registration, the house expropriation department shall submit an opinion to the county (city, district) people's government for determination.
Where ownership and management rights are separated, the actual operator may be compensated for operating losses, employee unemployment benefits, relocation costs, depreciation compensation for interior decoration and auxiliary facilities invested by the operator, but no duplicate compensation may be made for the same project.
被征收人在签订征收补偿协议时，应将被征收房屋的权属证书和国有土地使用证交给房屋征收部门，房屋征收部门应当及时到相关部门办理注销手续。 Article 31 When signing an expropriation compensation agreement, the expropriated person shall submit the ownership certificate and state-owned land use certificate of the expropriated house to the house expropriation department, and the house expropriation department shall go to the relevant department for timely cancellation procedures.

Before applying for compulsory enforcement by the people's court, the house expropriation department shall apply to a notary office for evidence preservation of the expropriated house, and the compensation amount and the bank account number stored in the decision on expropriation compensation, the location and area of the property exchange house and revolving house And other materials for notarization.

The auditing agency shall supervise the management and use of house collection and compensation fees, and the house collection department may also commission audit institutions to conduct follow-up audits and publish the audit results.
因征收房屋导致被征收人居住地或户籍发生改变的，其子女的义务教育入学可选择在原户籍所在地的学校，或选择户籍迁入地的学校，任何学校不得拒绝接收。 Article 37 If the place of residence or household registration of the requisitioned person is changed due to house expropriation, the children's compulsory education enrollment may be in the school where the original household registration is located or the school where the household registration is moved in. If the house expropriation involves major illness, complete loss of labor, and special difficulties in family life, etc., the applicant shall apply for verification of the township government, subdistrict office, or civil affairs department where the house is located and the contract is completed on time. Chapter IV Legal Liability
房屋征收部门和其他相关部门有下列行为之一的，对直接负责的管理人员和直接责任人依法给予处分；造成严重后果的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任： Article 39 If the house collection department and other relevant departments have any of the following behaviors, they shall be punished according to law to the directly responsible managers and directly responsible persons; if they cause serious consequences, they shall be liable for compensation according to law; if they constitute a crime, they shall be investigated for criminal responsibility according to law responsibility:
(1) Initiating the implementation of a house expropriation project that does not meet the prescribed procedures;
(2) Corruption, misappropriation, private distribution, interception, or arrears of compensation for house collection;
(3) Choosing to use intermediary agencies and personnel who do not meet the requirements to engage in house expropriation work;
(4) Tampering with, forging, or issuing false certificates, or instructing tampering, forging, or related materials of house expropriation and issuing false certificates;
(5) Conflicts between major liability accidents and group incidents caused by negligence, malfeasance or decision-making errors in the process of house acquisition;
(6) Other illegal acts stipulated by laws and regulations.
被征收人伪造、涂改被征收房屋有效权属证明文件骗取征收补偿款，违反治安管理行为的，依法给予治安管理处罚；情节严重，构成犯罪的，依法追究刑事责任。 Article 40 If the expropriated person forges or alters the valid ownership certificate of the expropriated house to defraud the expropriation compensation and violates the security management behavior, he shall be punished according to law; if the circumstances are serious enough to constitute a crime, he shall be investigated for criminal responsibility according to law.
Those who hinder the house collection staff from carrying out the collection work according to law shall be punished by the public security organs according to law; if they constitute a crime, they shall be investigated for criminal responsibility according to law.
各类中介服务工作人员在房屋征收与补偿工作中不履行本办法规定的职责，或者滥用职权、玩忽职守、徇私舞弊的，由所在单位或者主管部门责令改正，通报批评；造成损失的，依法承担赔偿责任；构成犯罪的，依法追究刑事责任。 Article 41 If various types of intermediary service workers fail to perform their duties as stipulated in these Measures, or abuse their powers, neglect their duties, or engage in malpractices for personal gain, they shall be ordered to make corrections and report criticism; If it constitutes a crime, it shall be investigated for criminal responsibility.

Chapter V Supplementary Provisions
